10 year jail term for rape of five-year-old

A FIVE-year-old girl, who was lured from a family party and sexually assaulted in the street, still suffers nightmares from the abuse by a family friend.

A jury convicted Suriya Choomwantha earlier this year of abducting and raping the young girl outside a gathering at Springfield in November, 2010.

Choomwantha, 49, who was sentenced in Brisbane District Court on Thursday to 10 years in jail, had known the victim's grandparents for about 20 years.

Crown Prosecutor Caroline Marco said Choomwantha went to the birthday party on November 13, 2010, and was seen with the victim 10-30 minutes before he took her away.

Ms Marco said Choomwantha - a father of three - called the victim's name, picked her up, took her out the side gate and dragged her on the road.

He took the girl behind a red car and assaulted her.

The court heard the girl sustained significant internal injuries.

"When (the victim) was with him she said she could hear her name being called but he wouldn't let her go and he held her tight," Ms Marco said.

Choomwantha eventually released the girl and she returned to her family.

Ms Marco said the victim described having nightmares and being scared of the man.

Ms Marco said the effects on the victim and her family were likely to be long-standing and far-reaching.

Defence barrister Don MacKenzie said Choomwantha had no criminal history and was an excellent provider to his children.

Judge Deborah Richards sentenced Choomwantha to 10 years jail and made a serious violent offence declaration.

The declaration means Choomwantha will have to serve 80% of his jail sentence.
