Accused murderer's mother posts $300k surety for bail

A BUNDABERG father accused of a cold-case murder more than a decade ago has been granted bail after his mother posted a $300,000 surety to secure his release.

Shane Anthony Eric Hansen, 34, was charged in October this year with murder over the alleged bashing death of Darren John Britza, 31, on March 23, 2001, at a panel beating workshop on the Gold Coast.

Mr Britza's remains were discovered seven years later buried in a shallow grave beneath the Canungra Creek Bridge at Boyland in the Gold Coast hinterland.

It is the second time Mr Hansen has been charged with Mr Britza's murder.

The Brisbane Supreme Court heard on Tuesday, during a bail application, that Mr Hansen was again charged with Mr Britza's murder after a new witness had been found.

The court heard Mr Hansen was initially charged with Mr Britza's murder in October, 2012, after he was summoned to appear before the then Queensland Crime and Misconduct Commission the year before.

He was subsequently granted bail in January, 2013, before the charges were dropped in January this year after a magistrate ruled there was insufficient evidence to proceed with the murder charge.

Justice David Boddice said this was an extraordinary situation given a court had ruled there was insufficient evidence to proceed with the murder charge only for a witness to suddenly appear nearly 14 years after the fact.

He said he found it unbelievable police had not discovered the new witness until recently.

"Why this witness has only turned up now is not for me to speculate on," he said.

"But I am satisfied Mr Hansen has shown cause and his continued incarceration is not justified."

Two other people have also been charged over Mr Britza's death.

Jade Maree Clarke, 40, was sentenced to life behind bars in May this year after a jury found her guilty of being involved with Mr Britza's murder.

Dean Mark Wills, 40, who has also been charged with murder, is due to face trial in February next year.
