Back pain excuse doesn't pass muster in court

A NORTH Mackay concreter busted with a makeshift bong and four grams of marijuana during a traffic stop told police he used the drug to treat back pain.

That excuse wasn't accepted in Mackay Magistrates Court on Monday though.

Magistrate Damien Dwyer questioned how Damien Andrew Nicholi Olsen, who pleaded guilty, earned about $3000 per week if his back gave him so much grief.

He also noted a history of similar offending stretching back to 1998, and said Olsen was on probation at the time of the August 27 traffic stop.

Sentencing was adjourned while a pre-sentence report was obtained.
