Rapist fails to secure appeal based on 'irrational' Jury

A CONVICTED Bundaberg rapist has his appeal dismissed.

On August, 2014 Shannon Robert Barrett, also known as Shannon Robert Dunrobin, was convicted at trial of rape.

He was acquitted of three other rape charges and an unlawful assault charge at the same trial.

He was sentenced to four and a half years jail, with the four years he served before the High Court ordered a retrial declared already served.

He appealed the sentence to the Court of Appeal claiming he was involved in a consensual relationship with the victim and the jury's verdict was unreasonable.

The court heard Barrett raped the young male victim while they were both staying in a Bundaberg house.

Barrett did not dispute the sex occurred but claimed it was consensual. During the trial RJ told the court Barrett raped him up to 63 times, but only four counts were charged. Barrett claimed throughout their sexual relationship he and RJ were in a relationship.

In his appeal Barrett claimed the guilty verdict was as it was "based solely on the deficient evidence of the complainant whose evidence … was rejected by the jury on the other four counts; and that it is likely to have been the result of an irrational compromise".

But Justice Robert Gotterson said the jury was open to believe the victim.

"I consider that it was open to the jury to be satisfied beyond reasonable doubt of the appellant's guilt," he said.

The appeal was dismissed.
