Crown closes case against fatal crash which killed brothers

THE Crown has closed its case in the trial against a man charged with causing a fatal traffic crash in 2011.

Roderick Sidney Leach is accused of dangerously driving on the Bruce Hwy on October 16 and causing the deaths of Mark and Fenton Wooley and grievous bodily harm to Craig Greening.

Crown prosecutor Clayton Wallis said the crown case was Leach was on the wrong side of the road at the time of the crash.

The Wooley brothers were in a Subaru Imprezza being driven by Aaron Murphy, while Leach was driving a Toyota Camry with Mr Greening in the front passenger seat.

The District Court in Mackay was told when Mr Murphy first saw the Camry it was in the right lane.

However, at a "sweeping bend" in the highway Murphy said the Camry failed to turn with the road and contributed driving straight crossing into the oncoming traffic lane.

The two vehicles collided about 6.45am.

Both crown prosecution and defence are expected to present their closing arguments this afternoon.

WHAT started out as two separate fishing trips quickly turned to tragedy.

Roderick Sidney Leach is accused of causing a fatal two-vehicle traffic crash that killed brothers Mark and Fenton Wooley and seriously injured Craig Greening.

He pleaded not guilty in the District Court in Mackay yesterday to dangerous driving causing death and grievous bodily harm on the Bruce Hwy at Pindi Pindi on October 16 in 2011.

Defence barrister Stephen Zillman, for Leach, suggested the driver of the other vehicle was travelling between 18 and 27km over the speed limit at the time of the crash.

The Wooley brothers were travelling to Proserpine to go fishing in a Subaru driven by their friend Aaron Murphy.

At the same time Leach was driving toward Mackay with Mr Greening in a Toyota Camry.

They had driven from Townsville where they'd been on a work fishing trip.

Mr Greening had initially driven, but he said Leach took over driving near Bowen.

Contrary evidence put before the court suggested Leach took over driving in Cannonvale after dropping another man off.

The crash occurred about 6.45am at a "sweeping bend" in the highway.

Mr Murphy told the court when he first saw the Camry it was in the correct lane, but it didn't turn with the bend in the road and so it travelled into the wrong lane.

He tried to turn his vehicle into the opposite lane to avoid the crash but he was unsuccessful and the two vehicles collided on their front left sides, the court was told.

Mr Murphy denied driving between 118 and 127km at the time of the crash.

Data analysis of the Camry showed it was travelling at 96km and did not brake prior to the crash.

The trial, under Judge Hugh Botting, continues today.
