No bail application for alleged police biter
UPDATE 4.45PM: A man charged over an alleged violent incident in Kearneys Spring yesterday afternoon has been remanded in custody.
No bail application was made before the Toowoomba Magistrates Court this afternoon during a brief mention of the matter.
Magistrate Damian Carroll adjourned the matter to Tuesday morning.
8.45AM: A man alleged to have bitten and spat at police during a violent incident in Toowoomba yesterday afternoon will appear in court this morning.
The 42-year-old Mt Lofty man is charged with a string of offences including common assault, serious assault police and wilful damage after an incident that began about 3.25pm Sunday on Ruthven St at Kearneys Spring.
Police were called to a the area with an initial report a man was walking in and out of traffic on Ruthven St where it is alleged the 42-year-old tried to pull a man and a young boy from a motorbike.
Police will allege the man grabbed the arm of the male rider and his young pillion passenger before he tried to climb onto the motorbike.
The motorbike rider, 36, and the 10-year-old boy managed to escape and report the incident to police who then located the man further down the New England Hwy walking in the middle of the road.
Police have then made attempts to arrest him when the man allegedly resisted and a violent struggle ensued.
The man is alleged to have bitten a male officer, 49, three times on the wrist, thumb and forearm during the struggle before back-up was called.
More officers then arrived at the scene including some off-duty officers.
Police will allege the man spat in the fact of a 41-year-old male officer before he and other police officers were able to restrain the man.
It will be further alleged the man struggled while being put into a police vehicle and when being transported to the watchhouse, caused damage to the police vehicle.
Police will allege the man continued to struggle when at the watchhouse at which time a 34-year-old female officer received injuries to her wrist and thumb.
She was taken to St Vincent's Hospital for treatment.
The 42-year-old Mt Lofty man will appear in Toowoomba Magistrates Court today on a number of charges including attempted unlawful use of a motor vehicle, two counts of common assault, two counts serious assault police, one count each of serious assault police by biting and serious assault police by spitting, and two counts of wilful damage of police property.
The three officers injured in the incident were transported to hospital and are understood to be recovering from their injuries.
