Charleville murder accused remanded in custody

A MAN accused of murdering his former partner in Charleville in 2009 has been denied bail.

Louis James Mahony has been charged with murdering Lainie Coldwell, who was found with a severe head injury at the base of a tree in Charleville in August 2009.

Mr Mahony, 42, applied for bail at Brisbane Supreme Court on Monday when his lawyer Phil Hardcastle argued that medical evidence was weak in the prosecution case against his client.

He said the prosecution's medical evidence cast doubt over how Ms Coldwell's injuries may have occurred.

But Melissa Wilson, acting for the Director of Public Prosecutions, disagreed, arguing medical evidence showed Ms Coldwell did not have any other injuries on her legs, arm or feet to suggest that she fell out of the tree.

Mr Mahony's family, including his parents, wife and sister, sat at the back of the court room during his bail application.

Supreme Court Justice Martin Daubney said evidence before the court from pathologists who examined Ms Coldwell's body after she died were not able to determine the weapon used to cause serious head injuries that led to her death.

But he said the Crown had a "significant body of circumstantial evidence" relating to Mr Mahony allegedly taking out, or being involved in taking out, a number of insurance policies before Ms Coldwell's death.

Justice Daubney also said there was evidence Mr Mahony allegedly contacted insurance companies after she died.

The court also heard Mr Mahony has also allegedly previously tried contacting Crown witnesses in the case, in 2010 and 2014.

Justice Daubney said Mr Mahony was an unacceptable risk to be released on bail and refused his application.
