Christmas in jail for man accused of assault
GEORGE Stanley John Kirk will be spending Christmas Day in a jail cell after his bail was denied in Rockhampton's Magistrate Court yesterday.
The Gladstone man was charged with one count of assault occasioning bodily harm after he allegedly punched and kicked a man on December 15 just after 1pm.
The court heard, via teleconference, that Kirk had attended a residence and assaulted the victim.
Police Prosecutor Sam Pyke told the court Kirk "ripped the victim's chain off his neck and punched and kicked the victim about three or four times."
However, Kirk's sister has claimed that Kirk was not present at the residence at the time of the assault.
"She said Kirk was in court registry at the Gladstone Magistrate Court the time this offence was committed but we can't confirm that," Senior Constable Pyke said.
"We are waiting on court CCTV footage from that day. His sister has now said her memory is unclear of that day."
Kirk's bail was denied and he will be remanded in custody until his next court date in January.
