Wandoan gas worker vindicated at appeal

A COURT has over-ruled a magistrate's "infected with error" guilty verdict in the case of a worker who was injured at a Wandoan gas plant.

The Taroom Industrial Magistrates Court in 2013 found Dennis William Schloss guilty of two Petroleum and Gas Production and Safety Act breaches.

The alleged breaches related to an accident at a Santos QNT-leased gas plant near Wandoan on March 16, 2011.

A maintenance worker was injured after a section of the plant flew off.

The magistrate found Mr Schloss failed to comply with safety requirements and was therefore responsible for the "bodily harm" suffered by the worker.

Mr Schloss appealed the magistrate's decision and on Wednesday the Industrial Court of Queensland ruled in his favour.

ICQ Deputy President Daniel O'Connor set aside the guilty verdict and dismissed the complaint.

"The appellant has succeeded in demonstrating that the decision of the industrial magistrate is infected with error," he said. - APN NEWSDESK
